I contacted Cameron Law Firm back in Summer of 2021 after the VA kept denying me DIC Benefits after my late Veteran husband's death. I had the pleasure of being assigned Attorney Mrs. Megan Ellis Mrs. Ellis has been Awesome to work with from start to finish she explained every single detail of my claim she was able to win myself and my son DIC Benefits on a Higher Level Review Appeal we both were very pleased with the outcome. While Mrs. Ellis was representing me on my DIC VA Claim she saw in my late husband's C-File he had a "Pending Claim" for TDIU for an earlier effective date which I forgotten all about after his death. She helped me file the substitution application to "Step in as my late husband" after I was approved for substitute on his pending TDIU Claim she filed a Supplemental claim which was denied then we filed a Higher Level review claim which was also denied. I was about ready to give up but Mrs. Ellis stated we can file an BVA Appeal for "Direct Review" The BVA Judge ended up Remanding the claim back to the RO and put in her remand instructions to send my late husband's claim for "Extra Schedular Rating" consideration with the Dept of Compensation and Pension Services. I had no idea what extra schedular rating even was but Mrs. Ellis went great detail explaining that A VA extra-schedular rating is a higher-than-usual disability rating awarded when a service-connected condition is so exceptional or unusual that the standard rating schedule does not accurately reflect the disability's severity or its impact on earning capacity. After doing my research I found that extra schedular ratings are very rare to get Granted. After the RO Completed the BVA Judge's remand instructions my late husband's file was finally sent to Washington as Mrs. Ellis explained to me the Board can't Grant an extra schedular rating until it is evaluated by Dept Compensation and Pension Services first Finally it Felt like we had someone on our side that agreed with my late husband's severity with his disability. We finally got notification my late husband's extra schedular WAS GRANTED! The Board asked for earlier effective date of Feb 2009 My Late was husband was "posthumously" Granted an earlier effective date of May 2008! Cameron Law Firm came through for my son and I BIG TIME!
